XENTIM SYNTHETIC CCTV FIRE & SMOKE DATASET, STARTER PACK (v1.0) DATASET LICENCE AGREEMENT Version 1.0, 27 October 2026 LICENSOR TATO STUDIO sp. z o.o., trading as Xentim ul. 28 Czerwca 1956 r. 174/28, 61-507 Poznan, Poland KRS 0000995718, NIP (VAT) PL9721332292 ("Licensor") This Licence applies to every copy of the Dataset delivered under an Order. An "Order" is the order form, quote, invoice or online checkout accepted by both parties that names the licensee ("Licensee"), the edition and the fee. If an Order and this Licence conflict, the Order prevails. 1. GRANT Licensor grants Licensee a non-exclusive, non-transferable, non-sublicensable, worldwide, perpetual licence to use, reproduce and modify the Xentim Synthetic CCTV Fire & Smoke Dataset, Starter Pack, its documentation and any updates delivered under the Order (the "Dataset") solely for the Permitted Uses. The licence takes effect when the fee is paid in full. The free sample (xentim_fire_smoke_starter_sample20), where offered, is licensed without an Order, free of charge, for internal evaluation only, under Sections 3 to 14. It may not be used to train models deployed in production. 2. PERMITTED USES Licensee may use the Dataset to train, fine-tune, validate, test and benchmark discriminative machine learning models, including models for fire, smoke and hazard detection, false-alarm reduction, video analytics and safety alerting, and may deploy and sell such models and products built on them. Models trained on the Dataset, and their weights and outputs, are owned by Licensee and are not considered copies of the Dataset. 3. PROHIBITED USES: GENERATIVE AI Licensee shall not use the Dataset, in whole or in part, (a) in datasets utilized by Generative AI Programs, (b) in the development of Generative AI Programs, or (c) as training inputs or prompt inputs to Generative AI Programs. "Generative AI Program" means artificial intelligence, machine learning, deep learning, neural networks or similar technologies designed to automate the generation of, or aid in the creation of, new content, including image, video, audio or text content. For clarity, models that solely classify, detect, localize, segment or score input data (for example, outputting a "fire" / "no fire" label, bounding boxes, a confidence score or event timestamps) are not Generative AI Programs. 4. PROHIBITED USES: MILITARY AND MASS SURVEILLANCE Licensee shall not use the Dataset, or models trained on it, (a) for military purposes, including weapons, targeting and military surveillance or reconnaissance, or (b) for mass surveillance, meaning the tracking, monitoring, identification or profiling of individuals or groups without their consent or a valid legal basis, including biometric identification of people in public spaces. Detecting fire, smoke and similar hazards in security, safety and building-management systems is permitted. 5. NO REDISTRIBUTION AND NO MISREPRESENTATION Licensee shall not sell, sublicense, publish or otherwise make the Dataset or any substantial portion of it available to third parties, including as part of another dataset, except to its affiliates and contractors acting on Licensee's behalf under written obligations at least as protective as this Licence. Licensee is responsible for their compliance. Licensee shall not present Dataset media as real recorded events, remove the indication that they are synthetic, or use them to deceive, impersonate or create false evidence. Publication of aggregate metrics, figures and up to 20 individual frames in scientific or marketing materials is permitted if they are labelled as synthetic and attributed under Section 8. 6. LAWFUL AND ETHICAL USE Licensee shall use the Dataset and any models trained on it only in compliance with applicable law, including data protection and artificial intelligence regulation (for example the GDPR and the EU AI Act). Licensee, as the provider or deployer of any AI system built with the Dataset, is responsible for that system's conformity with such regulation. 7. SYNTHETIC CONTENT AND THIRD PARTY COMPONENTS The Dataset is entirely computer-generated. It contains no recordings of real people, places or events and no personal data within the meaning of the GDPR. Any people, vehicles, signs or timestamps visible in it are fictional. Scene images were generated with Krea 2 (Krea, used under the Krea 2 Community License) and video with Wan 2.2 VACE and the lightx2v distillation (Apache License 2.0). Bounding boxes were produced by Licensor's own change-detection pipeline. No third party models, weights or source footage are included in the Dataset. Licensor is responsible for its own compliance with these licences in producing the Dataset; Licensee's use under this Licence does not require a separate licence from those parties. The third party licensors are not parties to this Licence, have not endorsed the Dataset and provide no warranty in respect of it. 8. ATTRIBUTION When publishing results obtained with the Dataset, Licensee shall cite: "Xentim Synthetic CCTV Fire & Smoke Dataset, Starter Pack v1.0, (c) 2026 TATO STUDIO sp. z o.o." 9. WARRANTY, REPLACEMENT AND SYNTHETIC DATA DISCLAIMER Licensor warrants that the Dataset materially matches its datasheet at delivery. If it does not and Licensee notifies Licensor within 30 days of delivery, Licensor will correct the Dataset or, if it cannot, refund the fee against deletion of all copies. For 12 months from delivery, Licensor will also replace individual clips that Licensee reports as defective because of visible generation artefacts or wrong labels. These are Licensee's sole remedies for defects. Otherwise the Dataset is provided "as is". Licensor does not warrant that models trained on it will reach any detection rate or meet any safety, security or regulatory requirement. The Dataset is not a substitute for certification testing of fire detection or life-safety systems (for example EN 54 or UL). Licensee is solely responsible for validating its models on real world data before deployment. To the extent permitted by law, the statutory warranty for defects (rekojmia) is excluded. 10. LIMITATION OF LIABILITY Licensor's total liability arising out of or in connection with this Licence is limited to the fees paid by Licensee under the relevant Order. Licensor is not liable for lost profits, lost revenue, loss of data, business interruption or any indirect or consequential damage, nor for any damage caused by a model, product or decision of Licensee or its customers. These limits do not apply to damage caused intentionally or where the law does not allow them. 11. TERMINATION This Licence terminates automatically if Licensee breaches Section 3, 4 or 5 and does not cure the breach within 30 days of written notice (a breach of Section 3 or 4 cannot be cured by notice once it has occurred). Upon termination Licensee shall delete all copies of the Dataset and confirm deletion in writing. Models trained in compliance with this Licence for Permitted Uses before termination may continue to be used. Sections 3, 4, 7, 9, 10 and 13 survive termination. 12. CONFIDENTIALITY The Dataset is confidential information of Licensor. Licensee shall protect it with at least the care it uses for its own confidential information, and no less than reasonable care. 13. GOVERNING LAW AND DISPUTES This Licence is governed by the laws of Poland, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods. Disputes shall be resolved by the common court having jurisdiction over Licensor's registered office in Poznan, Poland. The English version is binding. 14. ENTIRE AGREEMENT This Licence and the Order are the entire agreement on the Dataset and supersede any prior proposals. Changes require written or electronic form accepted by both parties.
